We've heard some important news regarding new building law that has been introduced in Spain, from the guys at Grupo New Villas. They've kindly given permission for the info from there website to be reproduced here.

 

"IMPORTANT New Build Law New 10 year Insurance construction guarantee.

As of the 6 th of may 2001 all promotors and constructors operating in Spain have to offer by Law a full insurance backed guarantee to each individual clients project.

NEW VILLAS was the first company in the Albox area of Almeria to comply with this new Law which insures that each clients property will be built to the highest standards utilising reinforced pillar construction techniques normally associated with large blocks of apartments.

When looking to have a new property built in Spain you need to make sure that the promotor/constructor offers this insurance and that it is written into the build contract, he should be able to prove to you or your solicitor that he is operating according to this new law by providing examples of Geotechnic ground compression tests and certified reports from companies like Cemalsa S.L /Secotec S.L, they should also provide the insurance companies Name eg Catalan Occidente Spains largest insurance group. (we use the above companies).

BEWARE:

If you have a property built without this insurance then you can expect many problems including NOT being able to register a new property on your plot of land.

Notarios, Registerd Architects, the deed registry office, and the land registry office (Catastral) now work in conjunction and this insurance process cannot be hidden under the carpet. If you buy without it then your are putting your hard earned money at SERIOUS RISK.

Some companies say they operate operate according to this new law however you need hard proof before you buy, computer printed certificates are not uncommon and are worthlees.
